1. Acceptance of Terms

By accessing or using RentSight ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and RentSight. Please read them carefully before using our platform.

2. Description of Service

RentSight is a property management software-as-a-service (SaaS) platform that enables landlords and property investors to:

Track property details and values
Manage rental units and tenant information
Monitor financial metrics and cash flow
Generate reports and projections
Provide tenant portal access for maintenance requests

3. Account Registration

To use the Service, you must:

Be at least 18 years old
Provide accurate and complete registration information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities under your account

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

4. Subscription and Billing

Free Tier

The free tier allows you to manage up to 2 properties with basic features at no cost.

Pro Tier

The Pro subscription provides unlimited properties and additional features. Pricing is available on our website and may be subject to change with 30 days' notice.

Payment Terms

Payments are processed securely through Stripe
Subscriptions are billed in advance on a monthly or annual basis
All fees are non-refundable except as required by law
You authorize us to charge your payment method for recurring fees
Failed payments may result in service suspension

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Violate any applicable laws or regulations
Infringe on the rights of others
Upload malicious code or interfere with the Service
Attempt to gain unauthorized access to our systems
Use the Service to send spam or unsolicited communications
Resell or redistribute the Service without authorization
Use automated systems to access the Service without permission

6. Intellectual Property

Our Property

RentSight and its original content, features, and functionality are owned by RentSight and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your Data

You retain ownership of all data you enter into the Service. By using the Service, you grant us a limited license to use your data solely for the purpose of providing the Service to you.

7. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

Scheduled maintenance (with advance notice when possible)
Emergency repairs or security updates
Factors beyond our reasonable control

We are not liable for any damages resulting from service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Service is provided "as is" and "as available" without warranties of any kind
We disclaim all implied warranties, including merchantability and fitness for a particular purpose
Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
We are not responsible for decisions you make based on information from the Service

10. Indemnification

You agree to indemnify, defend, and hold harmless RentSight and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

By You

You may cancel your account at any time through your account settings. Upon cancellation, your access to Pro features will continue until the end of your current billing period.

By Us

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to us, other users, or third parties. We will provide notice when reasonably possible.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination. After 30 days, we may delete your data in accordance with our data retention policies.

12. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved as follows:

Good Faith Negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation for a period of 30 days
Mediation: If negotiation fails, the parties may agree to non-binding mediation
Jurisdiction: Any legal proceedings shall be brought in the courts of Alberta, Canada

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice by:

Posting the updated Terms on our website
Sending an email notification to your registered email address
Displaying a notice when you log in to the Service

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
